Are they are laws or statutes governing privacy fencing and structures built inside them.?

In a San Antonio TX community the covenant and deed restrictions states that privacy fence cannot exceed 6 feet. A homeowner builds a deck surrounding an above-ground pool that is as tall as the fence. What laws govern the privacy of others since this deck has now encroached on everyone else's privacy.
